Liability Waiver & Release Of Claims

1. Assumption of Risk

I acknowledge and fully understand that participation in endurance sports training and related activities involves inherent risks, including but not limited to:

• Intense physical exertion and cardiovascular stress

• Swimming in pools and open water

• Cycling on public roads with vehicular traffic

• Running on roads, trails, or other surfaces

• Environmental hazards, including weather and terrain

• Potential for accidents, falls, collisions, and equipment malfunction

 

I voluntarily assume all such risks, both known and unknown, even if arising from the negligence of Toro Performance, LLC or its representatives.

 

2. Medical Clearance

I certify that I have been examined by a licensed physician and declared medically fit to participate in strenuous physical activity. I agree to immediately disclose any medical condition, injury, or limitation that may affect my ability to safely engage in training.

3. Release of Liability

In consideration of being permitted to participate in coaching, training, or related services provided by Toro Performance, LLC, I hereby release, discharge, and covenant not to sue Toro Performance, LLC, its owners, coaches, employees, contractors, affiliates, or agents (collectively, the “Released Parties”) from any and all claims, actions, damages, liabilities, or demands of any kind, including those arising from negligence, that may result in personal injury, illness, disability, death, or property damage.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, or causes of action brought by third parties arising out of or related to my participation in Toro Performance, LLC programs, including attorney’s fees and costs.

5. No Guarantee of Results

I understand that athletic performance depends on many factors beyond the control of Toro Performance, LLC, and I acknowledge that no guarantees of improvement, competition outcomes, or specific results are made or implied.

6. Governing Law & Jurisdiction

This Waiver shall be governed by the laws of the State of Arizona, and any disputes shall be resolved in the state or federal courts of Maricopa County, Arizona.

7. Severability

If any provision of this Waiver is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Acknowledgment of Understanding

I have carefully read this Waiver and fully understand its terms. I acknowledge that I am giving up substantial legal rights, including the right to sue, and I sign this document freely and voluntarily.
